in that event to issue a certification of representative to the Petitioner for such unit, which the Board, under the circumstances, finds to be appropriate for purposes of collective bargaining. If, however, a majority vote for the Intervenor, they will be taken to have indicated their desire to remain a part of the existing production and maintenance unit, and the Regional Director is instructed to issue a certification of results of election to such effect.

Case No. 24-CA-843.November 12, 1958 DECISION AND ORDEROn June 27, 1958, Trial Examiner David London issued his Intermediate Report in the above-entitled proceeding, finding that the Respondent had engaged in and was engaging in certain unfair labor practices and recominending that it cease and desist therefrom and take certain affirmative action, as set forth in the copy of the Intermediate Report attached hereto. Thereafter, the Respondent filed exceptions to the Intermediate Report and a supporting brief.Pursuant to the provisions of Section 3(b) of the Act, the Board has delegated its powers in connection with this case to a threemember panel [Chairman Leedom and Members Bean and Jenkins].The Board has reviewed the rulings made by the Trial Examiner at the hearing and finds that no prejudical error was committed. The rulings are hereby affirmed.
