Case 14CA- 11813August 6, 1979 DECISION AND ORDERBY MEMBERS JENKINS, PENELI.O, AND TRUESDALE Upon a charge duly filed by Carpenters' District Council of Greater St. Louis, AFL-CIO (hereinafter the Union), on September 8, 1978,. and duly served on Joseph J. Callier, et al., d/b/a Callier's Custom Kitchens, a Co-Partnership (hereinafter Respondent), the General Counsel of the National Labor Relations Board, acting through the Regional Director for Region 14, on October 3, issued a complaint against Respondent. The complaint alleged that Respondent violated Section 8(a)(5) and (I) of the National Labor Relations Act, as amended, by refusing and failing to execute and abide by the contract negotiated on its behalf by the Associated Cabinet Shops and Laminating Industry of St. Louis (hereinafter the Association) and by refusing to furnish, upon written request of the Union, certain information which is necessary and relevant to the effective administration of the associationwide contract. By answer filed on October 5, Respondent denied that it committed the unfair labor practices alleged in the complaint.Thereafter, a hearing was held in the above-entitled proceeding on October 30, 1978, before Administrative Law Judge George F. Mclnerny of the National Labor Relations Board. On November 1, the parties filed a motion to transfer the proceeding to the Board.The parties agree that the testimony developed at the hearing before the Administrative Law Judge contains no question of fact for his determination and that no credibility issues are presented.
