DECISION AND ORDER

On December 8, 2004, Administrative Law Judge Jay R. Pollack issued the attached decision.  The Respondent filed exceptions and a supporting brief.  The General Counsel filed cross-exceptions, a supporting brief, and an answering brief.

The National Labor Relations Board has considered the decision and the record in light of the exceptions and briefs and has decided to affirm the judgeÂ’s rulings, findings,2 and conclusions and to adopt the recommended Order.3

ORDER

The National Labor Relations Board adopts the recommended Order of the administrative law judge and orders that the Respondent, Service Employees International Union Local 1877, Division 87, AFL–CIO, San Francisco, California, its officers, agents, and representatives, shall take the action set forth in the Order.

DECISION

Statement of the Case

Jay R. Pollack, Administrative Law Judge.  I heard this consolidated case in trial at San Francisco, California, on September 14, 15, and 29, 2004.  On March 7, 2003, Hugo Brolyn filed the charge in Case 20–CB–11894–1 alleging that SEIU Local 1877, herein described by its correct name, Service Employees International Union Local 1877, Division 87, AFL–CIO (Respondent or the Union) committed certain violations of Section 8(b)(1)(A) of the National Labor Relations Act (the Act).  On May 21, 2003, Brolyn filed an amended charge against the Union alleging violations of Section 8(b)(1)(A) and (2) of the Act.  On June 16, 2003, Mumar Abdo Alhanshali filed the charge in Case 20–CB–11973–1 against Respondent.
