On January 15, 1959, Trial Examiner Ralph Winkler issued his Intermediate Report in the above-entitled proceeding, finding that the Respondent had not engaged in the unfair labor practices alleged in the complaint, and recommending that the complaint be dismissed in its entirety. Thereafter, the General Counsel filed exceptions to the Intermediate Report, and a supporting brief.The Board has reviewed the rulings made by the Trial Examiner at the hearing and finds that no prejudicial error was committed.The rulings are hereby affirmed. The Board has considered the Intermediate Report, the exceptions and brief, and the entire record in this case, and adopts the findings, conclusions, and recommendations of the Trial Examiner only insofar as they are consistent with the following Decision and Order.The amended complaint alleges, inter alia, that the Respondent, pursuant to a tacit arrangement and understanding with Armco Drainage & Metal Products, Inc., herein called Armco, refused to clear the complainant, George W. Copeland, for employment at a project in Foreman, Arkansas, and thereby attempted to cause, and caused, Copeland's discharge in violation of Section 8(b) (1) (A) and (2) of the Act.
