July 17, 1972 DECISION AND DETERMINATION OF

DISPUTE

1. THE BUSINESS OF THE COMPANY The Company is a utility contractor largely but not exclusively engaged in the laying of gas distribution 1 pipelines in western Pennsylvania. During the 12 months preceding the hearing, the Company purchased goods and materials valued in excess of $50,000 from firms outside the Commonwealth of Pennsylvania for use within the Commonwealth.

We find that the Company is engaged in commerce within the meaning of the Act and that it will effectuate the purposes of the Act to assert jurisdiction herein.
