SUPPLEMENTAL DECISION AND ORDER

On July 5, 2001, the Board issued its decision in this case, finding that the Respondent violated Section 8(a)(1) of the Act by filing and maintaining an unsuccessful lawsuit against International Brotherhood of Electrical Workers, Local Union No. 98 (Local 98 or the Union), in retaliation for the exercise of rights protected by Section 7 of the Act.[1] On February 1, 2002, the Board filed an application for enforcement with the United States Court of Appeals for the Third Circuit. On June 24, 2002, the Supreme Court issued its decision in BE&K Construction Company v. NLRB, 536 U.S. 516 (2002). On October 11, 2002, the Third Circuit granted the Board’s request to remand this case to the Board for further consideration in light of the Supreme Court’s decision in BE&K and the parties’ joint stipu...
