DECISION AND DIRECTION OF ELECTION STATEMENT OF THE CASE Upon a petition duly filed by Guards, Watchmen and Firefighters Local Union No. 22970, A. F. of L., herein called the Union, alleging that a question affecting commerce had arisen concerning the representation of employees of Tampa Shipbuilding Company, Incorporated, Tampa, Florida, herein called the Company, the National Labor Relations Board provided for an appropriate hearing upon due notice before Charles W. Schneider,

Trial Examiner. Said hearing was held at Tampa, Florida, on March 8 and 9, 1945. The Company and the Union appeared and participated. All parties were afforded full opportunity to be heard, to examine and cross-examine witnesses, and to introduce evidence bearing on the issues. At the hearing, the Company nioved to dismiss the petition on the grounds that the guards are not employees of the Company and that a unit of such guards is inappropriate. For reasons stated hereinafter, the said motion is hereby denied.
