DECISION AND ORDER

BY CHAIRMAN GOULD AND MEMBERS FOX AND HURTGEN

On August 28, 1997, Administrative Law Judge D. Randall Frye issued the attached decision. The General Counsel filed exceptions and the Respondent filed an answering brief.

The National Labor Relations Board has delegated its authority in this proceeding to a three-member panel.

The Board has considered the decision and the record in light of the exceptions and brief and has decided to affirm the judge's rulings, findings,1 and conclusions2 and to adopt the recommended Order.

ORDER

The recommended Order of the administrative law judge is adopted and the complaint is dismissed.

CHAIRMAN GOULD, concurring.

I join the majority in finding that the Respondent did not violate Section 8(b)(1)(A) by refusing to agree to the crediting of pension fund contributions for non-striking employees during the pendency of the strike. In the instant case, there is no contention that...
