Investigation and Certification of Representatives: existence of question: refusal to accord union recognition; election necessary.

A contract executed between the Company and a rival union following the union's certification by a State Labor Board does not constitute a bar to an Investigation and Certification of Representatives where the pay-roll check conducted by the State Labor Board, who had no power to certify a collective bargaining representative, did not establish that the union represented a majority of the employees in an appropriate unit and where the Company had knowledge of the petitioner's claim and petition to the Board prior to its execution.
