February 29, 1972 DECISION ON REVIEWBY CHAIRMAN MILLER AND MEMBERS FANNING,JENKINS, AND KENNEDY On April 9, 1971, the Regional Director for Region 13 issued a Decision and Direction of Election herein finding, inter alia, (1) that 29 former economic strikers placed on a preferential hiring list have a reasonable expectation of reinstatement during 1971 and (except for 10 whom he permitted to cast challenged ballots) were eligible to vote and (2) that one Dean Bess is not a supervisor as defined in the Act and therefore included in the unit. In accordance with Section 102.67 of the National Labor Relations Board Rules and Regulations, Series 8, as amended, the Employer filed a request for review of the Regional Director's Decision as it relates to finding (1), above, and the Union filed a request for review as to his finding (2), above, both asserting that, in making the findings in question; he departed from officially reported precedent.
