Scully, Administrative Law Judge. Upon a charge and amended charge filed by Edwin R. Melhorn on September 13 and December 12, 2006, respectively, the Regional Director for Region 5, the National Labor Relations Board (the Board), issued a complaint on December 22, 2006, alleging that Wegmans Food Markets, Inc. (Respondent), had committed certain violations of Section 8(a)(1) and (3) of the National Labor Relations Act (the Act). The Respondent filed a timely answer denying that it had committed any violation of the Act.A hearing was held in Baltimore, Maryland, on March 15, 16, 19, and April 3, 2007, at which the parties were given a full opportunity to examine and cross-examine witnesses and to present other evidence and argument.
