Thereafter, the Charging Party filed a motion and limited exceptions to Trial Examiner's Decision.Pursuant to the provisions of Section 3(b) of the National Labor Relations Act, as amended, the National Labor Relations Board has delegated its authority in this proceeding to a three-member panel.The Board has considered the record and the Trial Examiner's Decision in light of the Charging Party's motion and limited exceptions. For reasons set out below, the Board has decided to grant the Charging Party's Motion in part and to make certain additional factual findings and remedial provisions as below described, but to affirm the Trial Examiner's rulings, findings,' and conclusions and to adopt his recommended Order in all other respects.The Charging Party's motion and limited exceptions to the Trial Examiner's Decision were based on factual allegations that, after the hearing in this case,Respondent had closed its plant and filed a petition under the Bankruptcy Act.
