On July 17, 2023,2the Respondent filed with the Board a request for special permission
to appeal from Administrative Law Judge Ariel L. Sotolongo’s July 14 Order denying its petition
to revoke subpoena duces tecum B-1-1J1PRGH. Specifically, the Respondent seeks review of
two of the judge’s rulings contained therein: (1) the judge ordered the Respondent to produce
electronically stored information in its native format or, alternatively, in searchable PDF format
as well as a TIFF+ format; and (2) the judge ordered the Respondent to be prepared to produce
documents included in a privilege log for an in-camera inspection if required.
The hearing opened on July 18. The Respondent produced documents responsive to the
subpoena in TIFF+ format alone, but Counsel for the General Counsel confirmed on the record
that he was able to access the underlying documents and had the evidence he needed to present
